Introduction

As AI Carbon Zero Credit Ltd. (referred to as "the Exchange", " AI Zero Carbon Credit Ltd ", "we", "us" or "our"), we prioritize the protection of personal data for our stakeholders and customers in compliance with the PERSONAL DATA PROTECTION ACT 2010 ("PDPA") Malaysia. "Personal data" includes any information identifying an individual, as defined by the PDPA and related regulations.

We may update the Privacy Policy to reflect changes in laws, industry trends, or regulatory requirements as needed. Any revisions will be posted here and take effect immediately. By using our website, products, or services, you consent to the current Privacy Policy and agree to our use and processing of your information as outlined therein.

Information that we collect.

We gather, utilize, retain, and transfer various types of personal data concerning you, encompassing, but not restricted to, the following:

This information encompasses visited pages, clicked links, entered non-sensitive text, mouse movements, and commonly collected data like referring URLs, browser type, operating system, and Internet Protocol (IP) address. We utilize publicly accessible sources to estimate your geographic region and Internet Service Provider based on your IP address. This information regarding your website usage, referred to as "Usage Data," may include personally identifiable information such as IP addresses. Additionally, interactions with the website or Exchange may lead to the provision of Personal Information to us, such as when you provide your name, email address, and username while signing up for a free trial of the Exchange.

 

Objectives for the Collection, Use and Disclosure of Personal Data

In general, the Exchange gathers, utilizes, and/or divulges personal data and Usage Data, and your consent is granted for these actions by the Exchange, serving the following purposes:

  • To deliver products and services to you.

  • To engage in communication with you regarding matters pertinent to your relationship with or interest in us.

  • To evaluate and enhance the products and services you currently use or may use in the future.

  • To selectively provide you with information about our products, services, activities, and/or events that are relevant to you.

  • To fulfill contractual or legal obligations under agreements between us and you, or between related corporations, affiliates, partners, and/or representatives of the Exchange and you.

  • To safeguard and uphold our contractual and legal rights and obligations.

  • To prevent, identify, and investigate criminal activities, including fraud and money laundering, and to analyze and manage other commercial risks.

  • To conduct audits, assessments, and analyses of our internal processes for action planning and commercial risk management.

  • To prevent, identify, and investigate criminal activities and ensure the safety and security of our premises and services (which may include CCTV surveillance and security clearances).

  • To adhere to applicable rules, laws, regulations, codes of practice, or guidelines, and to aid law enforcement and investigations by relevant governmental and regulatory agencies worldwide.

  • Any other purpose relating to the aforementioned objectives.

We may share personal data with our related corporations, service providers, agents, and other third parties, either with your consent for the stated purposes and any other reasonable ancillary purposes, for legal reasons, or where permitted under the PDPA and other applicable laws, such as in response to requests from law enforcement agencies.

Trans-border personal data transfer

When transferring personal data to countries beyond Malaysia, we ensure adherence to the pertinent provisions outlined in Malaysian laws and regulations. Moreover, we uphold compliance with applicable laws and regulations concerning the transfer of personal data to countries outside those where the data was initially collected.

Third Party Data

When you supply to us your personal data belonging to other individuals, you affirm that these individuals have consented to our collection, usage, and/or disclosure of such personal data for: (i) the specific purpose for which you disclosed it, or as notified to you at the time of disclosure; and (ii) the additional purposes outlined in this Privacy Policy above.

This involves verifying that the processor employs adequate technical and organizational safeguards and actively monitors compliance with these measures.

Data Integrity Principle

The Data Integrity Principle mandates that a data user must undertake reasonable measures to maintain the accuracy, completeness, and non-misleading nature of personal data. It is imperative to ensure that the data remains up-to-date in alignment with the original purpose for which it was collected and any subsequent processing activities directly associated with that purpose.

Control over personal information

  • you believe we have inaccurate information about you and you want to correct such data;

  • you wish to know what personal data we have about you in connection with your relationship with us and how your personal data has been used; or

It is important to note that we use personal data to provide you with the products and services you wish to use.  We also comply with various regulatory requirements in doing so, including the requirements for customer due diligence. Withdrawal of consent for the Exchange to collect, use or disclose personal data means that we may need to stop these activities. The absence of certain key personal data, including but not limited to your name, address, email and/or telephone contacts, personal identification numbers or banking information, may cause us to be unable to continue providing the relevant products and services to you.

2. Security Policies

This Security Policy (“Policy”) applies to the use of any product, service or website provided by AI Zero Carbon Credit Ltd (“Us”, “we”, “our” “Exchange” or “AI Zero Carbon Credit Ltd”) whether we provide it directly or through a third-party application (each, a ” Service”).  This Policy is designed to protect the interests of all of our clients (“Users”), as well as our goodwill and reputation, and the integrity of the AI Exchange Platform (“Platform”). We cannot accept any responsibility for any loss, disruption or damage to your data or your computer system which may occur whilst using material derived from this website.

The Platform is built on sophisticated technology to facilitate a secure, transparent and efficient trading environment for the Users. Our security protocols include ongoing monitoring and/or surveillance to recognize any abnormal system activities, transmission errors or unusual online transactions and ensure that such issues are adequately addressed.  We use all reasonable endeavours to ensure that our Users experience smooth and secure access to the Platform.  However, the Platform is provided “as is” and on an “as available” basis, without any representation or guarantee of any kind (whether express or implied). This means that we do not guarantee continuous, uninterrupted or secure access to ai-exchange.co (the “Site”), Platform or that its servers are free of computer viruses, bugs or other harmful components or that defects will be corrected.

We use all reasonable endeavours to make the Platform available when required by the User. However, we cannot guarantee the availability of the Platform. Errors and failures may occur in respect of Platform technology and the internet may be subject to faults and events which may affect the User access. Additionally, the User systems, our systems or the systems of a third party which the User or we rely on, may fail to work properly. As a result, Users may at times experience disruption or other difficulties in using the Site. Users should consider the potential for disruption or other difficulties in planning their use of the Site.

​We are constantly striving to improve the Platform. This means that the Platform may need to be suspended or updated as a result of periodic maintenance, repairs or upgrades. We will always seek to provide Users with prior notice of any service interruptions.

Our Users play an important role in ensuring the continuity and integrity of their access to the Platform. It is the User’s responsibility to have equipment, software and network connectivity that are appropriate to access the Platform and that meet the software and security standards set by us from time to time. We recommend that Users adopt the following security precautions and best practices for their personal computer and mobile device use in order to reduce the likelihood of causing malicious and/or harmful security breaches that may arise in the use of the Site and the Platform:

  1. ​Install anti-virus, anti-spyware, anti-malware and firewall software on your computers and mobile devices;

  2. Update operating systems, anti-virus and firewall products with security patches or newer versions on a regular basis;

  3. Remove or deactivate file and printer sharing preferences in computers and mobile devices, especially when connected to the internet;

  4. Make regular backup of critical data;

  5. Consider the use of encryption technology to protect highly sensitive or confidential information;

  6. Log off from the Site at the end of the online session; 

  7. Clear browser cache after the online session;

  8. Refrain from installing any software or running or executing programs of unknown origin;

  9. Delete junk, chain or spam emails;

  10. Avoid opening email attachments from unknown senders or from unknown email address domain names;

  11. Take care not to disclose personal, financial or credit card information to websites that are little-known, suspect, or do not have a matching website domain URL Address;

  12. Use the latest versions of Chrome, Firefox, Safari, or Microsoft Edge for purposes of accessing the Site.  For full functionality of the trading Platform, use the latest version of Chrome only;

  13. Do not use a computer or a device which you know has a breach in security vulnerability and cannot be trusted;

  14. Do not use public or internet café computers to access online services or perform financial transactions;

  15. Do not disclose your Platform username or password to individuals without authority to conduct transactions on your behalf; and

  16. When using two factor or multi-factor authentication, ensure that the authentication device, email or phone number are in your possession and control at all times.

Introduction

We are AI Zero Carbon Credit Ltd (referred to as the “AI Carbon Zero Credit Ltd” “we”, “us” or “our”) and we are committed to protecting our stakeholders’ and customers’ personal data in accordance with the PERSONAL DATA PROTECTION ACT 2010 of Malaysia (“PDPA”) and other applicable data protection laws.

“Personal data” means any data about an individual who can be identified (a) from that data, or (b) from that data and other information to which we have or are likely to have access to, as more specifically defined under the PDPA and other applicable data protection laws.

Our privacy policy (“Privacy Policy”) describes how we collect, use, store and protect personal data. The Privacy Policy also describes how you can control the personal data that we hold on you, and your rights on your personal data, where applicable.

We may from time to time update the Privacy Policy to ensure that it is consistent with future developments, industry trends and/or any changes in legal or regulatory requirements, or as we deem appropriate. We may share personal data with our related corporations, services providers, agents and other third parties, with your consent for the purposes set out above and any other reasonable ancillary purposes, for legal reasons, or where permitted under the PDPA and other applicable laws, such as in response to law enforcement agencies.

Trans-Border personal data transfer

If we transfer personal data to countries outside Malaysia, it will be done in accordance with the relevant provisions under Malaysia laws and regulations. We will also comply with applicable laws and regulations in relation to transfers of personal data outside countries where the personal data is collected. 

Third Party Data

Where you disclose personal data of other individuals to us, you warrant that such individuals have consented to us collecting, using and/or disclosing such personal data for: (i) the relevant purpose for which you made the disclosure or as was notified to you at the relevant time; and (ii) the other purposes as described above in this Privacy Policy.
